Driving under the influence of cannabis is illegal in New York and can result in a DWAI (Driving While Ability Impaired) charge. Unlike alcohol, there is no per se THC limit for drivers — law enforcement uses behavioral observations, field sobriety tests, and Drug Recognition Expert evaluations. Penalties for a first DWAI-drugs offense include fines up to $1,000, up to one year in jail, and a six-month license revocation. Cannabis must be transported in a sealed container or the trunk. Never consume cannabis in a vehicle, whether parked or moving. If you plan to consume, use our delivery service or arrange alternative transportation.
